How to File a Small Estate Affidavit in Michigan?
Follow these guidelines to claim and distribute a small estate of the deceased individual in Michigan:
- Adhere to the state regulations to ensure the state in question qualifies for the simplified procedure . You are required to wait for at least 28 days before formalizing the affidavit, the amount of the estate cannot be more than $24.000, and the document must be read and signed by a notary public otherwise it will not be considered valid. The affidavit can be filed by the spouse, adult child of the decedent, or any other affiant as long as their connection to the estate owner is clearly defined in writing - it can also be a representative appointed by the deceased individual before their passing.
- Complete the Michigan Small Estate Affidavit Form . Identify the estate owner and yourself indicating your relationship with the deceased individual and checking the appropriate box, enter the name of the county the decedent resided in last and the date of their death that matches the one from the death certificate, describe the assets you are expecting to receive and record their value, list the names and addresses of all the individuals and entities that are supposed to receive the real and personal property of the decedent, add your contact details, and sign the form.
- Once a notary public witnesses you signing the form, you may present it to any person or organization that holds the property of the estate owner and they will be obliged to release it to you or other heirs named in the affidavit.
