North Carolina Postnuptial Agreement: What Is It?

For residents of North Carolina, a North Carolina Postnuptial Agreement is a legal contract that is signed by spouses during their marriage. It will not be effective for individuals wishing to sign an agreement before or after a marriage. The contract will act as a documented agreement outlining the mutual arrangement approved by both parties about the way that a property will be inherited or divided in the event that a spouse dies or decides to get a divorce.

If this occurs, a case will be opened after which a judge can enforce the conditions of the agreement. A judge will do this if the criteria outlined below are abided by:

• Any agreements need to be documented in writing and signed by both spouses;
• The document should also either be notarized or signed before a judicial officer;
• There must be no pressure to make either spouse agree to the conditions of the agreement;
• Each spouse should provide information concerning their total finances and properties;
• There is a limit of three years for any claims that the document was signed illegitimately.
