New Jersey Postnuptial Agreement: What Is It?

A New Jersey Postnuptial Agreement is a legal contract formed between a married couple only when in a legal marriage. This document will not prove useful to those couples that are not yet legally married.

The main reason for creating the agreement is so to outline and determine the fate of any properties that are owned by the spouses. The event to trigger such action could be the passing of a spouse or if either party submits a petition for dissolution of marriage. The agreement will detail how the property will be shared or who will inherit it.

The spouse that has decided to create this agreement should:

• Submit proof that the agreement was signed fairly and completely voluntarily;
• The signing requirements for New Jersey state that both spouses need to sign the document. There is no need to have witnesses or a notary public be present;
• There are two types of these agreements in New Jersey. One for those that are not planning on getting a divorce and a separate one for those that are planning on getting a divorce.
