New Hampshire Postnuptial Agreement: What Is It?

A New Hampshire Postnuptial Agreement is a legal document created by two spouses during their marriage. It is important to understand that this agreement will not apply to those couples that are not yet married. The document is a legal guarantee outlining what will become of a property in the event that one spouse passes or opts for a divorce.

In the event that this does occur, a court case will be opened which will be taken to court for a judge to look at all of the evidence. The judge will then make a decision about the validity of the agreement. A judge will uphold the agreement as long as the information below is taken into account:

• There must be no force exerted onto either spouse when signing the document;
• Each spouse also needs to provide information about their finances including their assets and properties;
• The agreement should create fair conditions. If any circumstances have changed significantly, the document will be voided;
• The agreement should be signed by both spouses.

Only after this will the document become legally binding.
