Kentucky Postnuptial Agreement: What Is It?

A Kentucky Postnuptial Agreement is a legal document that is created by two spouses during the time that they are married - not prior to or post-marriage. The document serves as a formal, documented contract that details the way that a property is to be divided in the event that one of the spouses files for divorce or dies.

If the events described above do happen, a court case will commence which will be dealt with by the appropriate court. During this time, a judge can make a decision on whether or not to enforce the agreement. Generally, judges will agree as long as the criteria below are taken into account:

• Any arrangements need to be documented in a written agreement;
• There must be proof that no pressure has been exerted to force a spouse to agree to the contents of the agreement;
• Each spouse must provide information about their finances which includes information about any assets and properties;
• Such agreements may also detail information concerning financial reimbursement and custodial rights.

If a judge accepts the terms, the document becomes a legally binding contract.
