A Delaware Postnuptial Agreement is a contract that becomes legally binding from the moment that it is signed by two spouses and confirmed by the court. It is formed between two individuals already in marriage and the purpose is to detail what happens to any property if one spouse dies or if the marriage ends in a divorce.

If this document is signed and in place, any court case relating to inheritance post death of a spouse or a court case regarding marriage dissolution will speed up the process as the judge will already know how to delegate property. The following laws will apply in Delaware:

• Both spouses need to make sure that they sign the agreement;
• Any signatures in the document must be obtained fairly and without any external pressure;
• Both spouses need to be honest and clearly show their financial capabilities which includes income and properties;
• If this document is signed it is found that one individual will benefit in profit at the expense of the second spouse, the individual that is making the profit should prove that this is fair.
