An Alabama Postnuptial Agreement is a legal document formed by a married couple when they are already married - not prior to this.
The main reason for forming the document is that it will detail the fate of any properties that are owned by the couple. This could happen if one of the spouses dies or makes a petition for marriage dissolution. It will clearly outline how the property or properties are shared and the main criterion is that this should be done fairly.
The individual that has decided to enforce this agreement must prove everything is done fairly and not to hamper or diminish their spouse. If the spouse cannot prove this, they may face problems when it comes to enforcing the document on a legal level.
In Alabama, the signing requirements only state that the spouses should sign the agreement. There is no need to have witnesses or do this before a judge or notary public. As long as everything is done fairly and in agreement, the courts will have no problems in making the Postnuptial Agreement enforceable by law.
