How to File for Divorce in North Carolina?

To ensure that the divorce process is fair and that it provides equal opportunities, both spouses need to be absolutely transparent when it comes to their assets and income. If a judge in court makes a decision to implement the agreement in a legal sense, the parties outlined in the agreement would need to fulfill their obligations.

In North Carolina, this process will take approximately forty-five days and the filing fee will be $225. To trigger the divorce process you must:

  • Either spouse may file a complaint at the District Court with all relevant documents. The list of documents may vary slightly depending on your case;
  • You must then serve a notice to your former spouse to inform them that legal proceedings in regards to the divorce have been initiated. There are four acceptable ways to do this - you may choose one of the four;
  • After your spouse has received the notice, they have up to thirty days to officially form a response if they wish to do so;
  • A court date will be set and then a hearing will be held. During this, the judge will look at all of the evidence and weigh up all of the information that is in possession of the judge. If this is successful, the marriage will be considered dissolved on a legal level.
