This agreement is significant during the process and should be approached with great seriousness. How to File for Divorce in Mississippi?
To ensure that the divorce is fair and that each spouse will receive equal rights after the process, both spouses need to show the assets that they own as well as state their total income. If a judge upholds the divorce, the conditions described within the Marital Settlement Agreement should be complied with.
The divorce process in Mississippi will take a minimum of 60 days and a filing fee of a minimum of $50 must be paid, which is relatively cheap compared to most other states.
To initiate the divorce, you should:
- Ensure that you fall under the residency criteria of the state, which states that at least one spouse must have been living in the state for a minimum of six months;
- Then, depending on the circumstances of your divorce you need to fill out a packet of documents. These documents can be found at the Chancery Court of your local county within the state - it is to this court that you must also file all documents;
- You may then request a hearing but please be aware that you will need to wait a minimum of sixty days before your hearing is scheduled;
- The judge will then make a decision on your case and if it is successful, you may change your legal name.
