A New Jersey Prenuptial Agreement is created by a pair prior to getting married to prepare for potential separation or spousal death.

Each spouse should list the premarital possessions that they own personally and specify how they should be shared if indeed the marriage was to ever dissolve whilst creating the contract. It is important to be open and honest at this stage - if it is found that an individual did not completely discuss all of their assets, the agreement can be scrapped as a whole and it will not hold any legal weight.
Providing that any of the terms in the agreement do not go against local state laws or negatively affect a parent's capacity to care for a kid, the spouses could also set conditions that will include financial maintenance payments and a partner's rights in regards to parenting responsibilities. The contract would become operative if the pair gets married or enters a legal partnership.
The legal contract should be signed by both participants; while not mandatory by law, notarized recognition is advisable.
