A Michigan Prenuptial Agreement is written up with the intention of establishing in advance how and who will manage and divide a pair's assets, possessions, and estates in the event that their marriage ends.
Alternate Names:
Prior to this, it is important for the couple to openly and completely disclose all of their financial assets along with estates and any other significant possessions. Failing to do this could be grounds for recognizing the agreement as illegitimate, meaning the document cannot be implanted legally.
The agreement should always be signed before the couple can officially wed; it takes effect only after their union. A contract must be in writing, be signed by all involved parties (the soon-to-be newlyweds), and have a notary public witness it in order to be enforceable under local state laws. This is important as it will allow the document to hold a significant legal value meaning that it can be presented in court in the event of a legal case. Without a notary public seal, the document may be deemed invalid.
