A Massachusetts Prenuptial Agreement is a document that a partner signs before being married to specify how their properties and other financial assets will be divided if their marriage ends. Partners can prevent protracted divorce settlements as well as financial and property issues by drafting such an arrangement.

Once the wedding officially happens, the agreement goes into effect. Each party should disclose all of their existing obligations and assets in the agreement; otherwise, the agreement may not be enforceable - this is an extremely crucial condition. Additionally, the contract cannot be deemed to be unreasonably biased in favor of one partner. If any of these points are found to be violated, the agreement will not have any legal weight and will simply be refused in court.
The agreement must be recorded in the registration of deeds in the county in which the person lives at the moment of the registration, either prior to getting married or within 90 days of the marriage. The agreement is unenforceable if it has not been registered. Additionally, it must be registered in each county where property exists.
