A Maryland Prenuptial Agreement is a legal document that spouses are using more and more frequently to specify who owns something in the case of separation or the demise of one of the partners.

The partners must disclose the entirety of their possessions and financial obligations prior to signing the agreement. Aspiring spouses must take effort to ensure that the document's terms are fair in regards to both of the parties and that no unacceptable terms exist or are included in the agreement. When evaluating the agreement, it is frequently advised that each spouse hire their own attorney that will be able to review the agreement carefully. This will give the court the assurance that the terms of the agreement are reasonable and that nobody was forced to sign against their will.
Despite the absence of a legal obligation for signatories, a formal agreement needs to be signed by both parties in order to be enforceable. Although not essential, it is advised that these signatures be attested by notaries in order to guarantee that the documentation would be acknowledged in court.
