A Louisiana Prenuptial Agreement is a document that specifies how two people who intend to be married will divide their assets.
Alternate Names:
By signing this document, the partner chooses to forgo the formal marital system in favor of a "contract system," which will govern how assets are split in the event that the relationship dissolves due to the death of a partner or a divorce.
Prenuptial agreements, however, are not permitted under state law to restrict a partner's claim to support payments in the event of a divorce. After getting married, a pair is still permitted to make a marital contract, but in order for it to be approved by the courts, they will have to collectively file a petition.
There are specific signing requirements which must be considered when forming this document. It is compulsory for the partners to sign the document before a notary public which must then also validate the document with their signature and official seal. If these requirements are not abided by, the agreement will be invalidated meaning that it cannot be used in court.
