A Colorado Prenuptial Agreement is a document that two partners sign prior to their wedding and the purpose of this is to outline each side's financial obligations, possessions, and plans for how they will be divided in the case of a divorce or fatality.
Alternate Names:
It is advised that each side retains independent legal representation. In fact, whether one side was compelled and or barred from getting independent legal representation may reflect on how legitimate the agreement is and whether or not it can be enforced legally. Any concealed financial documents, proof that the agreement was signed against the consent of one of the partners and unreasonable clauses in the agreement are a few more points that could make the agreement unlawful and not legally enforceable.
The two partners should sign the agreement for it to be legally binding. Although there is no mandatory requirement to involve a notary public, this would still be a wise idea for the peace of mind of both parties as it provides legal confirmation concerning authenticity.
