For those living in Nevada, a Nevada Self-Proving Affidavit Form is a form which is attached to a final will with the main purpose of validating the will – in particular that it was signed freely and within state laws. Although there is no legal requirement to do this, it will give the person signing the will the reassurance that the will, will be upheld without any potential challenges during the court proceedings. It will make the probate process move a lot faster, which is in most cases particularly time consuming. Having the document on hand will also remove the need for any witnesses to go the court.
A Nevada Self-Proving Affidavit should be signed by the person writing up the will, the notary public and an additional two witnesses. All signatures should be signed before the notary public for the document to be acknowledged legally. Otherwise, it will remain invalid.
