Residents of Illinois require an Illinois Self-Proving Affidavit Form if they want to verify the will of a person. The form verifies two things: that the will itself is genuine and that it was created and signed not against the will of the person who formed it. These two factors are very important, particularly when the person passes away and the will reaches the court. If this document is in place, it will severely reduce the waiting times during the probate process which means that the individuals entitled to specific assets as outlined in the will, will be able to receive them faster.
As an Illinois Self-Proving Affidavit requires two witnesses, when the will reaches the court the witnesses will not need to be called and this again, serves to reduce the time of the probate process. In Illinois, the form does not need to be notarized – however, we would still highly suggest this.
