A Hawaii Self-Proving Affidavit Form is usually created by an individual who has written a will as it serves to confirm the legitimacy of the will and validate it legally. This is needed to increase the processing time of the probate process in court which is time consuming. By having this form attached to the will, it automatically acts as confirmation to the court that the will is genuine and was formed by free will. This fact will be confirmed by witnesses and as a result, witnesses will not be called to the court.
However, in order for this to be applied the form should be signed correctly. In Hawaii, the form requires two witnesses and a notary public to add their signatures. If this is not done or is done incorrectly, the form will not have any legal weight and cannot be considered as a legally binding document.
