A Florida Self-Proving Affidavit Form is a written legal confirmation that a will is legally recognized and was created freely, in agreement with the local laws. After the person creating the will passes away, the form (attached to the will) can then be used to legally confirm the validity in court which reduces the waiting times of the probate period. It also means that those individuals named as witnesses in the form do not need to attend the court to testify.
However, before signing the Florida Self-Proving Affidavit it is important to know about how to do this correctly. If not done in accordance with the local laws, the form could be classed as invalid meaning that it will hold no legal weight. In Florida, the main legal conditions specify that apart from the person creating the will, two additional witnesses will need to also sign the form. Any signatures added to the document should only be done so before a notary public.
