Self-proving Affidavit Form - California

Attaching a California Self-Proving Affidavit Form to a will formed by an individual has several advantages. Firstly, it will validate the authenticity of the document by helping to confirm that the document was indeed written in free will and that all local laws in California were conformed to. Creating this document will also decrease the waiting time of the probate process as no witnesses will need to be called to the court.

However, the California Self-Proving Affidavit does not necessarily need to be attached to the will itself. It is possible under California law for the individual writing the will to include an additional clause in the will itself detailing this information. Unlike other states, in California, only one witness would suffice when signing and in terms of the law, this does not even need to be done before a notary public – even though we would still strongly recommend to do so.
