An Arkansas Non-Compete Agreement is a document, signed by an employer and employee which will prevent a former employer from seeking employment in a different company for a certain amount of time. This is usually done to prevent confidential information from being spread by an employee once they decide to leave your company. This information could concern company secrets or details regarding clients. Otherwise, an employee could find another position in the business of a competitor and use the information acquired from their former employer for their own gain.
Two conditions should be met in order for the Non-Compete Agreement to be deemed as acceptable. The first being a genuine existing interest that the company wants to protect and the second condition relates to the amount of time that the agreement is valid for. Generally, the suggested reasonable amount of time is up to two years. However, if there are reasonable grounds to extend this time and there is proof as to why two years is not enough, then the time period can be extended.
