A Massachusetts Property Management Agreement is a document used in real estate to specify details about the agreement formed between the real estate owner and the individual or company managing the property on behalf of the owner. Both parties are obliged to carry out the functions written in the agreement. The owner would be expected to pay the manager as agreed, which could involve a standard monthly salary or a commission-based income from the portion of rent that tenants pay. On the other hand, the manager needs to manage the property and look after the state of it, organizing repairs when required. The manager must also work tightly with tenants, taking and controlling their payments and looking for new tenants when required. If any fees or fines need to be allocated to existing tenants, the manager is also responsible for this.
Managers in most cases are contracted on an annual basis after which the agreement may be redrafted. In Massachusetts, this procedure is largely simplified by the fact that property managers are not required to hold a real estate license, as is the case in most other states.
