Individuals who are thinking about conveying their real property should consider using a South Carolina Special Warranty Deed for this purpose. The South Carolina Code of Law contains a statutory form for conveyances of real property in fee simple (27-7-10). This form can be used for construing a special warranty deed since the code of law does not prevent individuals from including special warranties in it (27-7-20). In this type of deed, a grantor shall warrant that they legally own the title and that they will defend the title forever against any demands of persons claiming by, under, or through the grantor's name.
