Individuals and entities can use a North Dakota Special Warranty Deed when they would like to convey their real property to another individual (or entity) and imply that they did nothing to encumber their title of ownership. Following the provisions of the North Dakota Century Code, any deed in this state shall be executed in writing and signed by the grantor or by their agent authorized in writing (47-10-01). In addition to this, one of the requirements for a special warranty deed is that it must include the postal address of the grantee (47-10-07). If your deed is properly executed and includes all of the required information it shall be acknowledged or proven (47-19-03; 47-19-13; 47-19-14), and recorded in the county where the real estate is located (47-19-07).
