A New York Special Warranty Deed is a legal document in which the grantor guarantees the grantee the title only against claims that arose during the time the grantor owned that real property. To be a grantor and to be able to sell (or transfer) real property an individual must be of sound mind and lawful age, mentally competent, who legally owns the real property (RPP 11). After your special warranty deed was properly executed, duly acknowledged (or proven) it is eligible for recordation under section 291 (RPP) of the Consolidated Laws of the State of New York. Following it, all deeds shall be recorded in the office of the clerk of the county where the real property designated in the deed is located.
