A Massachusetts Quitclaim Deed is an instrument of conveyance which individuals and entities can use to transfer real property. A statutory form for such kinds of deeds implies certain warranty covenants, according to which the grantor guarantees that their real property is free from encumbrances (Title I, Chapter 183, Section 11; Title I, Chapter 183, Section 17). However, when a quitclaim deed is not used as a statutory deed, it does not provide a warranty of title, therefore, it is mostly used between family members or in situations when warranties are not needed. In Massachusetts, all deeds shall be duly acknowledged (Title I, Chapter 183, Section 30) and recorded in the registry of deeds (Title VI, Chapter 36, Section 12).
