A California Gift Deed is used when a person gifts property or real estate to another individual or party without an expectation of payment in return. In order for the gift deed to be deemed legally valid, the document must clearly dictate a complete legal description of the property, chain of title, any restrictions connected to the property, and be free of any unclear language that could later be contested in court. For the gift deed to be validated, all signatures will need to take place before a notary and all documentation will need to be sent to the county clerk's office in the county where the property is located.
