A Delaware Gift Deed is written when the owner of a property wants to donate or gift the property to another person or party without expecting payment for the transfer. The gift deed will require a full description of the property, including the chain of title and any restrictions held on the property. The person or party gifting the property must have a notary present during the signing of the document. A Realty Transfer Tax Return and Affidavit of Gain and Value will need to be signed by both parties and submitted along with all other documentation (9 Del. C. 9605(d)). All documentation and materials for the gift deed will need to be submitted to the Recorder of Deeds office for the county where the property is located.
