A Georgia Gift Deed is used when a person is donating or gifting property or real estate to another individual or party, and does not expect to receive payment for the property in return. The gift deed will need to have clear and exact language since any opaque language can result in the deed being contested through the courts. A notary and an additional witness will need to be present during the signing of the gift deed by the grantor (44-2-21(b)). The state will also require a Real Estate Transfer Form be submitted electronically. All other documents and materials will need to be submitted to the clerk of court's office in the county where the property is located.
