A Hawaii Gift Deed is required when the owner of a property or parcel of real estate wishes to donate or gift the property to another person or party without expecting payment from the grantee for the transfer. It is important that all language and agreements in the deed are clear, as any confusing language could later be contested in court. When the grantor signs the document a notary will need to be present and an additional witness if the notary does not know the grantor (Haw. Rev. Stat. 28:502-42). When submitting the gift deed documentation, you will need to determine if it will be sent to the Land Court (Torrens) or the Regular System.
