An Illinois Gift Deed is used when one party would like to gift or donate property or real estate to another party, with no expectation that they will receive payment in return. To begin writing the deed, be certain that all language and agreements in the deed are clear, since any unclear language could later be contested in court. A notary will need to be present at the time the grantor signs the gift deed, and if the notary is not known personally by the grantor, an additional witness will need to be present. You will need to confirm if you will also be required to complete a Real Estate Transfer Declaration (Form PTAX-203). All documentation and additional materials will then be submitted to the county's recorder's office where the property is situated.
