A Utah Deed of Trust is a legal document that can be used to secure a loan one individual has given to another individual to buy real property. The Utah Code contains a section where the legislator defines all of the terms that can be used in such kinds of deeds. As stated by it, a Deed of Trust is a deed executed in conformity with the code that conveys real property to a trustee in trust to secure the performance of an obligation of the trustor to a beneficiary (57-1-19). If your trust deed was duly acknowledged, then it shall be recorded in the office of the county recorder (57-1-36; 57-3-202).
