Whether you are giving a loan to a borrower, or plan to receive a loan from a lender, you can use a South Dakota Deed of Trust to secure the obligation to return the money. The South Dakota Codified Laws require all instruments of conveyance intended as mortgages, including deeds of trust, to be recorded as mortgages (44-8-11). Therefore, your deed of trust shall be recorded by the register of deeds of the county where the real property designated in your deed is set (43-28-1).
