The purpose of an Ohio Deed of Trust is to secure the loan you gave to an individual to buy real property and to make sure it will be returned on the terms stated in the deed. The Ohio Revised Code requires all documents executed in this state to be duly acknowledged and recorded in the office of the county recorder of the county where the real estate that is subject to the deed is set (5301.01). The code does not provide the state's residents with a statutory form for a deed of trust, nevertheless, it does not contain any provisions that would preclude individuals from using this type of deed.
