If you plan to purchase real property with a loan, you should consider using a Kansas Deed of Trust . Following the provisions of the Kansas Statutes, deeds can be used as mortgages if they are duly executed, acknowledged, and recorded in the office of the register of deeds of the county where the real property is located (58-2302). In this state, the deed of trust gives the grantee (also called a beneficiary) the power to sell real property (if the loan has not been returned to them in accordance with the deed terms), and such power is deemed as a part of security (58-2418).
