A South Dakota Grant Deed is supposed to be used to shift ownership of real property in South Dakota from a grantor to a grantee. The South Dakota Codified Laws define real property as real or immovable property that consists of land, what is affixed to the land, what is incidental to the land, and what is immovable by law. Other things are considered to be personal property (43-1-3). The law also states that by using the word "grant" the grantor implies covenants that the grantor has not conveyed the estate in question (or any right, title, or interest) to any person other than the grantee previously, and that the estate is free from encumbrances or personal claims other than the ones, stated in the deed (43-25-10).
