The purpose of the N180 Court Form is to determine the correct track for the case and to make sure all claimants and defendants agree with the direction taken by the court in question. Additionally, this statement allows both parties to agree to mediation, inform the court about the upcoming settlement or the resolution of the dispute that already took place, and name all potential witnesses that will be present during the hearing.
How to Complete Directions Questionnaire N180?
Follow these steps to prepare the N180 Court Form:
- Enter your full name, identify the court where the proceedings have begun, and write down the number of your claim.
- Carefully read the rules of mediation and give your consent to the case referral to the mediation service if you like (tick the appropriate box). There is an opportunity to obtain free and confidential mediation for small claims cases, which may be preferable for you and your opponent - the terms of the eventual agreement will be considered legally binding and the breaching party will be sanctioned.
- Record your name and add your contact information which is especially important if you request mediation and are looking for a potential out-of-court settlement of the case.
- Confirm that you believe the small claims track is the correct venue for your case. Usually, if your claim has a value of less than £10,000, the small claims track is appropriate. If you disagree, explain why and where do you want the case to be allocated.
- Indicate the location of the hearing you would prefer and provide a reason for it.
- If you are going to use expert evidence during the hearing, first you need to request the court's permission to do it. Provide the name of the expert if you know it already, state their area of expertise, and probable fees (not more than £750). Explain why do you require an expert witness.
- Record the number of witnesses who will present evidence on your behalf - and do not forget to count yourself as well. Note that it is up to you to cover travel and accommodation expenses for your witnesses.
- If you know there will be days in the next six months you or your witnesses will be unable to attend a hearing, state these dates.
- Answer "yes" if you require an interpreter for yourself or one of your witnesses. Write down the type of interpreter.
- Sign the form. Alternatively, it can be filled out and signed by the legal representative with proper authorization. Submit the questionnaire to the court office.
