How to Fill Out D8 Form?
Form D8 refers to the individual applying for a divorce as the "petitioner" (or "applicant"), while their partner is referred to as the "respondent". The actual form consists of the following parts.
-
Purpose of the Application. In the first part of the document, the applicant is supposed to designate which application they wish to make. They can choose from three options: an application for a divorce, for dissolution, or for (judicial) separation. Additionally, they must indicate which document they have attached to support their application.
-
About the Applicant. Here the applicant is required to provide their name, home address, and information about their solicitor (if they have one). They must also state whether their contact details can be shared with the respondent and indicate the address where the court can send the documents they issue.
-
About the Respondent. Similar to the previous section of the form, here the applicant must report their spouse's (or civil partner's) name, home address, and information about their solicitor (if they have one).
-
Details of Marriage (or Civil Partnership). Applicants can use this part of the document to provide information about their marriage (or civil partnership). It includes information about the date of their marriage, whether their marriage took place outside of the United Kingdom, if the details of their marriage certificate (or civil partnership certificate) are correct, and other types of information.
-
Reasons for Divorce. In this part of the document, the applicant can give reasons why they decided to file for their divorce (or dissolution, or (judicial) separation). They are provided with a list of reasons from which they are supposed to choose one or more factual reasons. They include adultery, behavior, desertion, and others. The applicant is required to provide evidence to the reasons they mentioned in this section of the form.
In addition to this, Divorce Form D8 has other sections, such as jurisdiction, adultery cases, supporting details, statement of truth, and other types of information that the applicant is required to provide to the court. After the applicant has filled out the document, they must submit it to the United Kingdom HM Courts & Tribunals Service Divorce Centre for their area in three copies. One will be returned to them with the court's seal, another one will be sent to the respondent, and the last one will be kept in the court files.
