How to Register a Firearm in West Virginia?

The state does not require a permit to sell, purchase, rent, lend, or gift firearms as long as the buyer, lessee, of giftee claims that they are legally allowed to possess and carry weapons.

In comparison with other states, West Virginia laws are considerably more lenient when it comes to firearm registration and ownership:

  1. The state does require a background check from the buyer during firearm sales between individuals.
  2. Firearm dealers are encouraged but not required to obtain a state license.
  3. West Virginia gun registration laws allow buyers to keep unregistered firearms.
  4. Individuals are not required to report stolen weapons nor are they required to receive a license to carry firearms.
  5. The state does not impose a limit on the number of guns that may be purchased at one time.

West Virginia requires individuals to carry a firearm if they are at least 18 years of age and have the right to carry weapons under Federal law. Concealed carry is allowed for individuals over 21 years old. If a person under the age of 21 wishes to conceal carry a firearm, they will need to apply for a Provisional Concealed Handgun License (CHL).

West Virginia residents that will need to travel out of state with their weapons will need to apply for a CHL. If approved, the applicant will be required to pay a fee of $15.00. The approved CHL will be valid for five years beginning on the date of issuance.

Does a Gun Bill of Sale Have to Be Notarized in West Virginia?

West Virginia does not require a notary public's certification for gun sales but it is generally a good idea to have a notary or witness to a sale in order to confirm the transaction has taken place. This can save any potential trouble which might occur should the seller or buyer contest the transaction at a later date.
