How to Write a Bill of Sale in Washington State?

To serve as protection for both parties and cover all possible issues and details, a Bill of Sale in Washington should include the following information:

  1. Identification of the parties. Write down their names, addresses, and driver's license numbers;
  2. Description of the transferred property that will allow its unambiguous identification. It depends on the item, but generally, you are required to provide the make, model, color, year, size, serial number. If the item has any customizations or accessories attached to it, mention them in this section as well;
  3. Transaction details. At a minimum, indicate the date and location of the sale and purchase;
  4. Payment information. State the price of the sold item and the negotiated method of payment;
  5. Seller's disclosure. It is the seller's duty to tell the buyer about visible and not immediately obvious faults and defects of the goods. If the seller does not provide any guarantees or warranties, the item is being sold in its current condition - "as is";
  6. Signatures of the parties or their legal representatives.

You are not legally required to fill out a Bill of Sale every time you are selling or buying minor personal property, and the state has not released any government-approved forms which can be used for this purpose. However, especially if the item is expensive and you want to create documentation for the transaction, consider signing a Bill of Sale. It serves as a purchase receipt for the buyer, proves that the purchaser is now the legal owner of the property, and releases the former owner from any responsibility for the sold item and its use.

Does a Bill of Sale Have to Be Notarized in Washington?

The state of Washington does not require a notary public's certification for sales but it is generally a good idea to have a notary or witness to a sale in order to confirm the transaction has taken place. This can save any potential trouble which might occur should the seller or buyer contest the transaction at a later date.
