Does a Firearm Bill of Sale have to be Notarized in Oregon?
You may add an extra layer of protection by asking two witnesses or notary public to witness and certify your Bill of Sale. Make two copies for the parties, the purchaser keeps the original. There is no mandatory registration, license, or purchase permit to obtain in Oregon, so the Bill of Sale is the only necessary document that proves the transaction took place.
How to Sell a Firearm in Oregon?
Oregon firearm laws do not require you to complete a Bill of Sale when you sell or buy a gun in this state. But it is strongly recommended to do so since this document protects both parties and is recognized by all government agencies. If you decide to draft your own Bill of Sale, do it as follows:
- State the full names and addresses of the seller and the buyer. It is a good idea to ask the buyer to provide an ID with a photo and to record the ID number on the Bill of Sale;
- Describe the gun you are selling. The description must provide an unmistakable identification of the firearm. Write down the type, make, model, serial number, and caliber of the gun. If it has any customizations or modifications, mention them as well;
- Add all the important terms of the deal. At a minimum, indicate the date and location of the sale and the payment information. Mention if you give the gun as a gift;
- Provide disclosures. The seller's disclosure must say that the seller is the legal owner of the described gun and has every right to transfer it. The buyer's disclosure usually states that the purchaser is of legal age and there is no prohibition to own a firearm under any laws;
- Sign the document.
