How to Sell a Boat in Illinois?

When selling a boat in Illinois, you should watch out for two aspects: the condition of the boat and the proper paperwork. The most important document you should prepare is the Illinois Boat Bill of Sale. Fill it out as follows:

  1. Enter your name and physical address;
  2. Indicate the name and address of the buyer;
  3. Provide a full description of the boat: the make, model, year, color, and hull identification number;
  4. If you sell the boat with an outboard motor or a trailer, add their descriptions and serial numbers as well;
  5. Enter the details of your deal. The minimal required information is the sales price of the watercraft and the date of sale. If you have agreed upon any additional terms, indicate them as well;
  6. Sign the document and ask the buyer to sign it;
  7. Prepare two copies of the document: for you and for your buyer. In addition, you should provide your buyer with the original Illinois watercraft title or the power of attorney and lien release letter (if applicable). Note that since June 2018, the Certificate of Title is not required for boats under 22 ft.

Though Illinois does not have any government-released form, the Bill of Sale is still a required document in most boat transfers. A buyer will need this document for use as boat registration if they have purchased:

  • Class 1 watercraft (Bill of Sale is required for the registration of jet skis and personal watercraft only);
  • Class 2 watercraft (boat length is 16 ft. to 25 ft.);
  • Class 3 watercraft (26 ft. to 39 ft.);
  • Class 4 watercraft (40 ft. and longer).

This document is necessary only if you buy a used boat from an individual or retailer. Used boats bought from a dealer do not require a Bill of Sale for registration.

Whether the document is required in your situation or not, you are still advised to prepare it. It will protect both parties of the deal from possible fraudulent claims. If properly filled out, it is important evidence of the transfer of the described boat. The transfer details like the date of sale and the sales price will be necessary if the Illinois Department of Revenue has any questions regarding the deal.
