The ATF Certification of Compliance is used to certify that nonimmigrant aliens comply with the law at 18 U.S.C. 922(g)(5)(B). The information provided on this form is used by the ATF to verify the citizenship of the applicant and to determine if they are legally eligible to import and/or possess firearms and ammunition. In order to be eligible, nonimmigrant aliens must hold a nonimmigrant visa, as this term is defined in the Immigration and Nationality Act.
This certification is to be completed by all listed responsible persons who apply for a Federal Firearms License (FFL). The law at 18 U.S.C. 922(g)(5)(B) does not permit any nonimmigrant alien to ship, transport in interstate commerce, or possess any firearm or ammunition that has been shipped or transported in interstate or foreign commerce. This definition includes any individual who is traveling temporarily in the United States, whether for pleasure or business, any individual who is studying in the United States but maintains a residence abroad, and also certain foreign workers. Permanent resident aliens are not included in this definition.
