Does a Boat Bill of Sale Need to Be Notarized in Hawaii?

Yes, since 2016 the signature of the boat seller must be certified by a notary public or an official authorized to take oaths. The Hawaii DLNR will not accept the Bill of Sale without notarization.

Hawaii Boat Bill of Sale

To be legal, the Hawaii Boat Bill of Sale must contain the following information:

  1. Date of sale;
  2. A specification if the watercraft is sold in part or in its entirety;
  3. Full description of the sold boat;
  4. Name of the seller and co-sellers (if any);
  5. Address of the seller and co-sellers;
  6. Signature of the registered owner. If more than one owner is registered, all of them must sign the form;
  7. Name and address of the buyer and all co-buyers;
  8. Signature of the buyer;
  9. Date of signature;
  10. Certification of a notary public.

How to Sell a Boat in Hawaii?

If you want to sell your boat in Hawaii, you should not only take care of its overall condition but also its paperwork. The Hawaii DLNR will not transfer the registration to the new owner if you owe the department any payments, have a pending citation for violating the department's rules, or if the vessel you sell is deemed grounded, derelict, or unauthorized. That is why you should make sure everything is settled before signing the Bill of Sale.

Remember also that after selling your boat, you must report the change of status to the Hawaii DLNR Division of Boating and Ocean Recreation . The notice must be made within 7 days of the date indicated on the Bill of Sale. To report the sale of the boat, change of address, removal from the state, theft of the boat, and other changes, the Hawaii DLNR has released the state-issued Form LNR 3-023, Change of Status.
