Form FL-311, Child Custody, and Visitation (Parenting Time) Application Attachment , is one of the supplemental documents California residents submit when asking the judiciary to issue an injunction concerning their visitation rights, supervised visitation, transportation of children and travel with them, as well as temporary custody decision until the matter is resolved in court. How to File Form FL-311?
There are three ways to file the FL-311 Form:
- Attach it to Form FL-300, Request for Order, when you wish to change existing orders in your case or ask the court to make new ones.
- Submit it with Form FL-320, Responsive Declaration to Request for Order, when you receive a request for order that you disagree with and would like to change the court's point of view.
- File it with Form FL-260, Petition for Custody and Support of Minor Children if the case has not been already opened in court.
Form FL-311 Instructions
Follow these steps to complete the Child Custody and Visitation Form:
- Identify the petitioner, respondent, and other parent or party . Record the case number.
- Indicate to which document you attach the application - petition, response, request for order, responsive declaration, or other.
- Choose what to demand . You may specify your intention to have custody of your children - list their names and dates of birth and identify people who have legal and physical custody over them.
- Break down the other parent to see children in the upcoming future . It is possible to attach another document where you can draw a schedule that shows when and where the children are going to spend the following weeks or months. You need to decide who will take care of children every day of the week and specify on which weekends the other party is allowed visitation.
- If you can submit a declaration that confirms the unsupervised visitation may harm your children, you may request supervised visitation - the parent will be observed by a professional or nonprofessional supervisor.
- Indicate your wishes concerning the transportation of children, their holiday schedule, and other custody provisions you deem necessary . The application lists forms you may have to submit to set out additional orders.
