What Is Form MV-901A?

Form MV-901A, Notice of Lien and Sale , is a legal document a garageman must use to notify a vehicle or vessel owner and any known lienholder of the intention to sell the property in question, to recover the costs of towing, storage, and repairs. A garageman's lien is a possessory lien that allows a licensed business owner to place a lien against a vehicle to secure the right to get paid.

NYS DMV Form MV-901A is the document to complete when informing the owner about the sale of the vehicle or vessel to satisfy a lien. A garageman can do it if labor or services were performed and have not been compensated.

MV-901A Form Instructions

Provide the following information in the Form DMV MV-901A:

  1. Write down the full names and addresses of the owner and lienholder. If there are additional lienholders or interested parties, check the appropriate box and attach a list of their personal details.
  2. Enter the garageman's business name and address. Notify the addressees that you claim a lien on the motor vehicle or boat currently in the garageman's possession.
  3. Describe the vehicle or vessel. State its year, plate, make, model, vehicle identification number, or hull ID number. Indicate the estimated retail value of the item prior to the filing of the lien.
  4. List all of the repair costs, towing, and storage charges. Enter the date of towing, the date storage began, and the amount of money owed for towing, repair, and storage. The document lets you write down miscellaneous costs that do not fall under one of the three main categories. Attach a copy of the dated invoice that itemizes the labor and cost of parts if you claim repair costs.
  5. Write down the date the original claim was due and indicate the total amount of money the owner has to pay.
  6. If you claim an additional lien for storage charges and charges incurred in enforcing the lien, list the date when storage began.
  7. Give the owner a date (at least ten days after service of the notice) to redeem the item.
  8. State the date, time, and place of the public auction (at least fifteen days after the date of the first advertisement) where the vehicle or boat will be advertised. Name the auctioneer.
  9. Write down your name in full, date the form, provide your address, and sign the document.

Once the form is completed and signed, send it to the vehicle owner and other interested parties by first-class or certified mail. After properly notifying all parties of the debt and the deadline to pay, the garageman may auction the vehicle or vessel to the highest bidder or make a claim of title with the DMV.
