What Is SBA Form 723?

SBA Form 723, Small Business Certification Required on All Preferential Sales of Set-Aside Timber is a form signed by the Purchaser of timber to certify that the timber sales contract is in accordance with the Rules and Regulations (13 CFR 121) of the Small Business Administration (SBA) .

The SBA released the latest version of the form on November 1, 1984 , with all previous editions obsolete. An up-to-date SBA Form 723 fillable version is available for digital filing and download below.

SBA Form 723 is a self-certification by the small business high bidder (the Purchaser) of a timber sale initiated by the government. The Purchaser agrees to perform the requirements of the sale contract following applicable SBA rules and regulations. A copy of the SBA 723 must be attached to the sales agreement when the agreement is initiated by the contracting officer.

SBA Small Business Certification

By signing the SBA Form 723, the Purchaser guarantees that their business:

  • Is primarily engaged in the wood industry or lumber industry (concerned with forestry, logging or timber trade);
  • Is independently operated and owned;
  • Is not dominant in its field of operation; and
  • Employs 500 or fewer people.

The Purchaser also certifies that:

  1. They agree not to sell or exchange more than 30 percent (50 percent for Alaska) of the timber of log volume from the preferential sale to concerns not meeting SBA's small business size standard.
  2. They will maintain the records of transactions involving timber or logs from the preferential sale for a period of three years.
  3. As much of such timber and log volume from the preferential sale as is necessary will be sold to one or more small businesses if their concern is purchased by, controlled by, or merged with a large business.
  4. If they utilize log volume from the preferential sale in the manufacture of a product, it will be done with their own facilities or those of another small business.
  5. In addition to other penalties for violating the foregoing, they may be declared ineligible to participate in future Federal timber sales.

If the business meets the small size criteria, which are based on its average gross receipts or the number of employees, it may obtain certification under the SBA's 8(a) Business Development Program or receive Historically Underutilized Business (HUB) Zone certification. These programs allow small businesses to compete for federal contracts, targeting competition in specific industries where there are disparities and increasing economic activity in distressed communities.
