What Is Form LB-0489?

Form LB-0489, Tennessee Separation Notice, is a document developed by the Tennessee Department of Labor and Workforce Development in order to indicate information about a worker's employment termination, which will later be used to determine their qualification for unemployment compensation. The document has been revised on June 1, 2015.

According to the Tennessee Employment Security Rules, a hirer must supply every worker with Form LB-0489 within 24 hours after their separation from employment. The hirer doesn't have to give the form to workers in two cases:

  • If a worker was in the employ for less than one week;
  • If a worker will be recalled in seven days or less.

Tennessee Separation Notice Requirements

Completing Form LB-0489 is quite a straightforward process, however, it is necessary to follow several requirements. It will help to avoid questionable situations and unexpected consequences.

  1. Form LB-0489 must be filled out entirely by an employer, this way the Department of Labor and Workforce Development will receive the information required to determine the eligibility of an employee to receive unemployment insurance.

  2. The reason for separation plays a significant role in the process. There is a list of circumstances that indicate misconduct and disqualify the separated employee from getting unemployment insurance, such as (but not limited to):

    • Firing for legal violations;
    • Failure to meet attendance requirements;
    • Violations of the employer's written rules.

These types of misconduct vary from drug or alcohol-related separations to skipping and participating in strikes and make employees ineligible to getting compensation. The reason for separation qualifies the separated employee for unemployment insurance. Since the reason for separation is so relevant and the compensation will be drawn from the employer's account, it is crucial to not only state the reason of separation but also give details about it. Otherwise, an employer might end up paying compensation to an ineligible employee.

Lastly, a hirer should indicate in Form LB-0489 whether the separated employee received:

  • Wages in lieu of notice. These are wages paid under circumstances in which the employer did not give advance notice of separation to the worker and are paid regardless of the length of service of the worker;

  • Severance pay. This is generally provided in cases where a worker is dismissed from a position due to situations like job elimination, downsizing, etc;

These matter when it comes to the determination of compensation due to the Unemployment Insurance Accountability, upon which unemployment insurance benefits are being denied to any claimant who is receiving or has received wages in lieu of notice equivalent to the wages they could have earned that week had they been permitted to work during the period of notice.
