What Is a Georgia Boat Bill of Sale?
Georgia Certified True Bill of Sale for Vessel (Form DNR LBRU) , is a legal document used to transfer the ownership of a motorized or non-motorized watercraft from the seller to the buyer.
Alternate Name:
- Georgia Vessel Bill of Sale.
It is one of the essential documents to make the sale and purchase legitimate. It shows the agreement of the parties, proves the payment in good faith, and protects both the seller and the buyer in case any problems or disputes arise after the sale takes place. It should sufficiently describe the boat and its current conditions (registration number, make, model, year, hull identification number and material, length, and color), identify the seller and the purchaser (full names and addresses), and state the date of the transaction. The seller needs to certify the vessel is free of any claims or liens and that all of the taxes have been paid. A Boat Bill of Sale in Georgia must be signed by both parties to be valid.
This form was issued by the Georgia Department of Natural Resources . The latest version of the document was released on July 22, 2020 , with all previous editions obsolete. You can download a fillable form through the link below.
How to Sell a Boat in Georgia?
There are several steps you must take when selling a boat:
- Before you start the sale and purchase process, make repairs to the boat - some defects and issues may prevent the sale. After that, you can determine the value of the vessel. Clean the boat and advertise it properly. Find the best location to present the boat to potential buyers;
- Find out which documents are needed to finalize the sale. Usually, it is a bill of sale and vessel registration application that proves the ownership. There are also other official papers that can show proof of ownership, for example, a dealer's invoice or court order. Sometimes, additional documents such as a copy of the Manufacturer's Statement of Origin, an out-of-state title, or registration card may be necessary. If the vessel is equipped with a marine toilet, you are required to obtain a certificate and a permit;
- Compose the bill of sale. Each party retains a copy of the document as a proof of purchase and payment;
- Give all warranty cards, maintenance records, and other documents to the buyer who becomes liable for registering the boat, paying the fee, and getting insurance. There are three types of boat registration: new, renewal, and transfer. Registration is a necessary step for all vessels with mechanical propellers and sailboats over 12 feet in length which are used on any waters within the territorial limits of Georgia. If the buyer wishes, the registration may be completed online. There is also a temporary boat registration which is available for vessel owners who wish to legally operate a boat for 60 days while awaiting the processing of their permanent title and registration.
Does a Boat Bill of Sale Need to be Notarized in Georgia?
A Boat Bill of Sale in Georgia does not require notarization. At the same time, no local laws prohibit you from having additional certification. If you feel that some issues may arise in the future, you can supplement the document with an additional section containing fields for signatures of two witnesses and a notary public certification.
