How to Sell a Vehicle in Indiana?
When selling a vehicle in Indiana, you must remember a few simple rules that will facilitate the process and protect you against possible legal issues:
- Fill out the Certificate of Title. Be careful as this is a legal document and any errors can void it;
- Prepare Indiana State Form 44237 in two copies. Keep one for your documentation and provide the other to the buyer;
- Remove the license plate from the sold vehicle. The Indiana BMV does not require you to return it. You can use a plate for a different car you own;
- All lienholders must release their interest in the car before the sale.
It is the buyer's responsibility to request a new license plate, certificate of title, and registration with the documents you provide.
The form is a simple one-page document. It consists of the following parts:
- Vehicle or Watercraft Information. This part requires a description of the transferred item: the year, make, model, and vehicle or hull identification number. If you sell a watercraft, provide the registration number as well;
- Sale Information. This section must contain the purchase price and the date of sale;
- Seller's Disclaimer and Information. The seller and co-seller (if any) should provide the full name (last, first, and middle initial or company name), sign the form, enter the date, and provide their full address with state and ZIP-code;
- Buyer's Disclaimer and Information. This part requires the printed name of the buyer and co-buyer (if any), buyer's signature, date, and full address of the buyer.
The form must either be printed or filled out in blue or black ink. The document should be prepared by the seller in two copies: one goes to the buyer, the other stays with the seller. By signing this document, the seller transfers all rights for the described vehicle or watercraft to the indicated buyer and states that the sold vehicle or watercraft is free from any liens.
